A federal court judge in New Jersey handed a defeat to Jaguar Land Rover North America, LLC’s (“JLRNA”) attempt to kill a class action lawsuit involving JLRNA’s defective InControl System. As owners and lessees of 2018 – 2020 JLRNA vehicles can attest, the InControl System does not function as advertised. The InControl System regularly freezes, has reduced function, refuses to respond to user input or startup altogether, or most commonly, displays only a blank or black screen. Virtually every single 2018-2020 JLRNA vehicle is impacted by this defect, including Range Rovers, Range Rover Sports, Range Rover Velars, Range Rover Evoques, Land Rover Discoverys, Land Rover Discovery Sports, Land Rover Defenders, Jaguar E-Paces, F-Paces, I-Paces, F-Types, XE’s, XF’s, and XJ’s.
While JLRNA has attempted to gut the class action settlement, implicit in the court’s finding is the notion that the InControl System defect relates to vehicle safety and can harm drivers through distraction or malfunction. The class action lawsuit has therefore been given the green light to proceed.
