A U.S. District judge for the Eastern District of Michigan, granted class certification in the case of Speerly v. GM, according to the Detroit Free Press.
The Complaint shows that General Motors knowingly sold vehicles with faulty 8-speed automatic transmissions, violating state consumer protection statutes. As anyone who owns an impacted Chevrolet, GMC or Cadillac can tell you, the transmissions lurch and shutter while driving, causing sudden or delayed acceleration and making the vehicles unsafe.
As our attorneys have known for years, General Motors directed its dealers to tell customers that harsh shifts were normal or characteristic, even though these harsh shifts were in fact dangerous and have caused serious accidents. Moreover, as soon as the powertrain warranty from General Motors expires, GM dealers will readily admit that the transmission needs to be replaced at the consumers’ expense. This is a violation of California’s lemon law!
The class action includes over 800,000 vehicles:
• 2015-19 Chevrolet Corvette
• 2015-19 Chevrolet Silverado
• 2016-19 Chevrolet Camaro
• 2017-19 Chevrolet Colorado
• 2015-19 Cadillac Escalade and Escalade ESV
• 2016-19 Cadillac ATS, ATS-V, CT6, CTS and CTS-V
• 2015-19 GMC Sierra, Yukon, Yukon XL and Yukon Denali XL
• 2017-19 GMC Canyon
The plaintiffs are seeking to recover the cost of replacing defective parts or the entire transmission as well as alleged overpayment for defective vehicles. This particular class action does not include California consumers, and that is a good thing in so far as individual lemon law claims in California deliver much better results for consumers than class action settlements. But nonetheless, California consumers should take action now before a similar class action is certified.
