General Motors, LLC (“GM”) continues its struggles with defective cars and trucks as it fights a class action lawsuit over defective Active Fuel Management lifters (AFM Lifters). Filed on December 15 in a federal court in Michigan, the class action lawsuit alleges that GM intentionally sold vehicles equipped with faulty AFM Lifters that could place drivers and passengers in danger.

According to the lawsuit, a valve train defect might cause vehicles to stall, hesitate, lose power while driving, or catch fire, all increasing the risk of a collision. GM made and sold these vehicles without disclosing that their AFM Lifters were defective in design, and if the defective engine valve-lifter is unremedied for too long, the entire engine can be damaged, necessitating an expensive full engine replacement.

The class of vehicles impacted includes 2014 – 2021 Chevrolet, GMC, Buick and Cadillac models equipped with a 5.3L, 6.0L, 6.2L V8 engine, AFM or DFM fuel management systems. Needless to say, the class covers quite a few vehicles. Plaintiffs allege not only that GM sold or leased these vehicles without disclosing that the AFM lifters were defective, but also that the manufacturer failed to fix the issue by replacing the parts with the same faulty components.

Although class action lawsuits often indicate large scale motor safety defects impacting thousands, individual lemon law claims are often far better for the average consumer. Whereas lemon law cases can result in refunds or meaningful cash settlements, class action settlements often deliver less.
