Subaru was recently sued in a class action over serious safety defects in 2012-2018 Subaru Forester, 2015-2019 Subaru Legacy and 2015-2019 Subaru Outback vehicles. The affected vehicles have an inadequate faulty detection system that is not robust enough to detect foreseeable problems, including unintended acceleration, according to the complaint. In addition, the throttle body assembly and other components have faulty circuit boards, the drivers said. It is further alleged in the class action lawsuit that the class vehicles’ brake override system malfunctions and is ineffective to sufficiently override acceleration, and that the drivers do not initiate and cannot control the vehicles.
Instead of recalling cars and informing customers about the alleged defect, Subaru told dealers to tell customers that their cars are operating normally or that no issues could be found, according to the suit. If you own a 2012-2018 Subaru Forester, 2015-2019 Subaru Legacy and 2015-2019 Subaru Outback and have taken your vehicle in on at least two occasions for this serious safety defect, California’s lemon law may apply to you and Subaru may be obligated to repurchase your unsafe Subaru.
