A class action against Nissan North America, Inc. related to 2013, 2014, 2015, and 2016 Nissan Altima vehicles is underway and a preliminary class action settlement has been approved. As many owners of 2013 – 2016 Nissan Altima vehicles have noticed, the CVT transmissions in Nissan Altimas are prone to lose power, stall unexpectedly in traffic, and prematurely fail.

Many Nissan Altima owners have made lemon law claims against Nissan and have had their vehicles repurchased pursuant to California’s lemon law. California’s lemon law is one of the strongest in the nation and requires to repurchase or replace lemon vehicles if the car company or its dealers cannot fix substantial defects in a reasonable number of attempts. The proposed class action settlement, however, drastically limits the rights of California consumers who drive 2013 – 2016 Nissan Altima vehicles. Instead of being able to have Nissan repurchase or replace your defective 2013 – 2016 Nissan Altima, the class action settlement limits your remedies to an extended warranty, a potential nominal credit towards the purchase of a new Nissan, and other nominal relief.

If you own a 2013 – 2016 Nissan Altima, Nissan Altima owners must eventually opt out here of the settlement otherwise they cannot bring a lemon law claim at a later date related to these specific issues.
