California’s lemon law is one of the strongest in the nation, designed to protect consumers by requiring car companies and consumer goods manufacturers and warrantors to repurchase or replace vehicles or consumer goods that suffer from warranty defects that cannot be fixed in a reasonable number of attempts. In other words, if you buy a product that is a lemon you are entitled to get your money back under the lemon law. A reasonable number of repair attempts has been interpreted by California courts to mean as few as two attempts to repair the same nonconformity under warranty.

With consumer protection in mind, the California lemon law was designed with an attorney fee-shifting provision requiring the car companies and warrantors to pay for the consumer’s attorney’s fees and costs if the customer prevails in a lemon lawsuit. This means that the consumer’s attorney’s fees and costs are paid for by the other side, not the consumer.
